The Infrastructure Division of Binh Trung Ward People’s Committee (HCMC) has asked the ward’s standing committee to consider not recognising the decisions and voting results of The Sun Avenue apartment owners’ meeting held on 20 and 21/12/2025, and proposed that the Management Board reorganise the meeting in line with regulations.
Findings from the meeting records
- On 5/8, a Binh Trung Ward working team directly inspected the meeting records after residents filed complaints, focusing on how proxy forms were received, reviewed and processed and how records were managed.
- A review of 559/613 proxy forms showed that the figures in the attendance register and the meeting minutes differed by 54 units.
- 78.4% of units attending by proxy were concentrated in 8 individuals belonging to the Management Board or the developer.
- In some cases owners said they had not given proxies, while records showed the proxy holder created files and inserted signature images to register attendance and receive ballots. The local authority will work to verify and clarify the responsibility of those involved.
Basis for assessing validity
- According to the Infrastructure Division, discrepancies between the attendance list and the minutes, together with proxy records not meeting regulations, affected the count of resident representatives, the conditions for holding the meeting and the approval rate of the voted items.
- This comes as residents protest the Management Board’s decision to raise parking fees without approval from the owners’ meeting.
Project and meeting scale
- The Sun Avenue is on Mai Chi Tho Street, Binh Trung Ward, HCMC, with 2,894 units including residential apartments, commercial service apartments and offices.
- The 2025 annual apartment owners’ meeting was held on 20–21/12/2025 with 915 owners attending, including 272 apartment owners and 643 proxies, equivalent to 31.6% of all apartments.
